Zambian Football icon and former FAZ president Kalusha Bwalya has requested for the dissolution of the current FAZ executive.
Bwalya acting together with, Damiano Mutale and Patson Lusaka have engaged Lawyers, to request Sports Minister Emmanuel Mulenga to dissolve the Andrew Kamanga led FAZ Executive Committee.
According to letter addressed to Mulenga, the trio through Lewis Nathan Advocates want the Ministry and the National Sports Council of Zambia to dissolve the Andrew Kamanga executive and leave the running the running of the institution in the hands of the General Secretary until the FAZ elective General Meeting.
“We have serious concerns regarding the position by FIFA that the current FAZ Executive committee should remain in office and should continue to manage Football activities in Zambia until elections are held,” read the letter in part.
Bwalya and Co argue that the continued stay in office by the Kamanga led Executive is in violation of Article 33 of the FAZ constitution and that the football governing can still operate under the office of the Secretary General’s office as provided for in Article 20.
“It should be pointed out that by Article 20 of the FAZ Constitution, the General Secretariat is the Executive, Operational and Administrative body of FAZ. This therefore entails that FAZ can continue to operate under the General Secretariat headed by the General Secretary whose position is non-elective until new office holders are elected at the Annual General Meeting.
“We further wish to bring to bring it to your attention Sir that Mr. Venon Masenga-Omba is on record as to advising FAZ to defy an Order of the High Court for Zambia staying the electoral process and the elections urging them to continue conducting the now halted elections.”
The letter further reads, “Our clients are aggrieved by the conduct of this (FIFA) official and will consider their options further should he continue with the stance that negates and disrespects the duly issued order of the High Court of Judicature for Zambia against which he has exhibited uttered contempt for.
“We would be grateful if your good office, acting through and/or together with the National Sports Council of Zambia, immediately instructs and/or directs the outgoing FAZ Executive to cease or stop holding themselves out as if legally constituted.”
“Our clients notify that should the said Executive continue holding themselves out as such for the next 5 days from the date hereof, they (our clients) shall have no option but to thereafter institute legal proceedings to secure compliance with not only FAZ statutes (as approved by FIFA) but also with relevant laws.”
